Conflict of Whose Interests?
Anthony Davis agreed to act as conveyancer for my purchase of a leasehold flat, whilst Janet Soliman agreed to act for the seller. Over a period of four years, Anthony Davis had given me good advice on two matters, and he was aware of potential problems with the lease. Janet Soliman had been the seller’s family solicitor over several years. Both apparently good and appropriate people to engage.

With this arrangement in place for only three days, Anthony Davis advised me by email that under SRA (Solicitors Regulation Authority) ‘rules’ he could not proceed, as there was a significant risk of a 'conflict of interests'. However, in Sections 6.1 and 6.2 of the SRA’s Code of Conduct, there are only two circumstances in which a conflict of interests may occur: between a solicitor and one client, or between two clients of the same solicitor. Neither of these applied in this case. But Mr Davis did wish me ‘good luck’ with my purchase of the flat as the door closed behind me! What was really going on here?
