When our father died nineteen years ago we learned, from a Codicil to his Will, that he wished for a Trust Fund to be set up specifically so that his eldest child, who suffered from long-term behavioural characteristics causing him to make unsound financial decisions, might still receive a share of his father’s legacy, but in the form of regular smaller and manageable payments drawn from the Trust capital under supervised conditions to cover essential personal expenses during his eldests remaining lifetime. Preferably, the Trust should be managed by two of his younger siblings, in order of age, acting as trustees.
As those trustees, we were proud to accept this enormous responsibly despite it being well outside the scope of our joint areas of experience! So, we quickly leaned on ‘The Aspire Partnership LLP’ to help us with the challenge.
We first consulted Steve Pine who prepared for us a detailed and easily understood Trustee Investment Report and then continued, at our request, to function as our financial adviser and to recommend and negotiate with a well-known Investment Management Company to set up a Trust Investment Bond. Steve kept us fully informed of progress all the way, generating all the paperwork ready for us to sign at each stage.
Sadly, in 2023 our eldest sibling died. This meant that the prime purpose of the Trust had been fulfilled and that we should begin the process of dealing with the financial matters which included: formally cashing in the Trust Investment Fund; fulfilling trust tax requirements and closing the HMRC Trust account and associated bank account.
For all this work, we consulted Ken Hall. Ken quickly matched the excellent service previously provided by Steve and carefully explained all the steps required up to the point of physically closing the Trust and tiding up the paperwork. At our request he even generated the final Tax Return for us. This critical document was posted to us under cover of a truly kind explanatory letter which had been typed by a member of the Planning Team who’d enclosed a strong large pre-addressed envelope for us to use for its return. All we had to do was to check and sign the document, then pop it into the envelope and drop it into the nearest post office!
